GREEN DOT – Please note the following with regard to the decisions of the Industrial Property Office of the Slovak Republic concerning the validity of Trademarks No. 585713, 585714, 653449 and 653450:
Please note with regard to Decisions of the Industrial Property Office of the Slovak Republic (“Office”) No. MOZ 585713 II/141-2011, MOZ 585714 II/143-2011, MOZ 653449 II/145-2011 and MOZ 653450 II/147-2011 of 21st December, 2011 that the Office has maintained in validity, for the territory of the Slovak Republic, the affected “GREEN DOT” International Trademarks No. 585713, 585714, 653449 and 653450 for services falling under the following classes as per the international classification of goods and services:
Class 35 - Consultancy for consumers and enterprises in matters related to the environment and wastes, i.e. reduction of the production of wastes, collection, transport, sorting of recycled materials, and elimination of wastes and raw materials for recovery purposes, consultancy for enterprises producing or using packages and/or packaging materials;
Class 39 – Collection and transport of wastes and raw materials for the purpose of recovering them for third parties;
Class 40 – Treatment of materials, recycling of packaging materials, recycling of wastes and raw materials for the purpose of recovering them for third parties;
Class 42 – Sorting of wastes and raw materials for recovery purposes, as well as sorting of the same by chemical, physical and/or biological means for third parties, consultancy in matters concerning the environment and waste elimination, consultancy as regards the development, selection and use of ecological and economical packages and packaging materials, including their labelling;
It follows from the foregoing that entities providing, in the territory of the Slovak Republic, services falling under the above mentioned classes as per the international classification of goods and services (e.g. waste collection and recycling services, consultancy services in matters related to the environment and waste) may not label the provided services with the above mentioned trademarks, except with the consent of Der Grüne Punkt Duales System Deutschland GmbH or that of ENVI-PAK, a.s.
The decision on the revocation of International Trademarks No. 585713, 585714, 653449 and 653450 for the territory of the Slovak Republic relates to all goods falling under classes 1,2,3,5,6,7,8,9,11,16,20,21,24,25,29,30,32,34, all services falling under class 36, and “public relations” services falling under class 35 as per the international classification of goods and services, with the effective date as of 6th December, 2007.
